1. Who We Are

AeroPrep Labs, LLC is a Wisconsin, United States-based company that provides digital study tools and simulated mock oral examination preparation for aviators.
 
2. Eligibility and Account Responsibility
 
You must be at least thirteen (13) years of age to access or use AeroPrep Labs. If you are under eighteen (18) years of age, you represent and warrant that you have obtained the consent of a parent or legal guardian.
 
By accessing or using the service, you represent and warrant that all information you provide is accurate, complete, and current. You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.
 
You agree to promptly notify AeroPrep Labs of any unauthorized use of your account.
 
3. Nature of the Service
 
AeroPrep Labs provides digital educational tools intended to assist users in preparing for aviation knowledge evaluations, including simulated and mock oral examination experiences.
 
AeroPrep Labs does not provide flight training, ground school, logbook endorsements, or any instruction required to meet Federal Aviation Administration (FAA) certification, currency, or regulatory requirements. AeroPrep Labs is not a flight school, training center, or FAA-approved instructional provider.
 
All required flight training, ground instruction, endorsements, and certifications must be obtained through properly authorized FAA-licensed instructors, schools, or training providers.
 
Use of AeroPrep Labs does not guarantee certification, examination results, checkride outcomes, employment outcomes, or regulatory compliance. The service is intended solely as a supplemental educational resource.
 
4. Subscriptions and Access
 
Subscriptions provide access to the service for seven (7) days from the time of purchase.
Subscriptions do not renew automatically. Access expires at the end of the subscription period unless renewed by the user.
 
AeroPrep Labs reserves the right to modify subscription pricing, structure, or access terms at any time. Changes will not affect subscriptions already purchased.
 
5. Payments and Refunds
 
Due to the digital nature of the service and the immediate access provided upon purchase, refunds are generally not offered.
 
Refund requests based on exceptional circumstances or technical issues may be submitted to support and will be evaluated at the sole discretion of AeroPrep Labs.
 
No refunds will be issued for suspensions or terminations resulting from violations of these Terms.
 
6. Acceptable Use, AI Integrity, and Security Protections
 
You agree to use AeroPrep Labs solely for its intended educational purpose.
 
You shall not:

• Share, resell, sublicense, or distribute access;

• Copy, scrape, reverse engineer, decompile, disassemble, or attempt to derive proprietary logic or system architecture;

• Use automated extraction tools or unauthorized scripts;

• Circumvent security measures, rate limits, access controls, or safeguards;

• Attempt to access, extract, reconstruct, or infer proprietary system prompts, examiner logic, ACS mappings, scoring methodologies, guardrails, or internal configurations;

• Attempt to develop or train competing products using the platform;

• Engage in adversarial prompting, malicious prompt injection, or attempts to override or suppress AI safeguards;

• Submit inputs designed to reveal hidden system instructions or confidential information;

• Manipulate examiner behavior, scoring logic, or structured evaluation flows;

• Disrupt or degrade platform performance.
   

“Malicious prompt injection” includes crafting inputs intended to override safeguards, expose internal instructions, manipulate evaluation logic, or cause the system to operate outside its intended educational function.
 
Any actual or attempted improper, unauthorized, exploitative, or adversarial conduct constitutes a material breach of these Terms.
 
7. Monitoring, Enforcement, and Termination
 
To protect platform integrity, AeroPrep Labs reserves the right to monitor usage patterns, logs, account activity, and system interactions to detect violations, abuse, fraud, or improper AI system manipulation.
 
You acknowledge and consent to such monitoring.
 
AeroPrep Labs may, in its sole discretion and without prior notice:

• Suspend or restrict access;

• Terminate subscriptions;

• Permanently ban accounts;

• Refuse future service;

• Preserve logs and technical evidence;

• Pursue legal remedies.
   

Termination may occur based on actual or attempted violations.
 
No refunds will be provided for suspensions or terminations resulting from violations.
 
8. Intellectual Property
 
All content, branding, system prompts, AI logic, structured examiner flows, training methodologies, platform architecture, and proprietary materials are owned by or licensed to AeroPrep Labs, LLC and protected by applicable intellectual property laws.
 
You are granted a limited, non-exclusive, non-transferable license for personal, lawful, educational use only.
 
No ownership rights are transferred.
 
9. Disclaimer of Warranties
 
The service is provided “as is” and “as available,” without warranties of any kind, express or implied.
AeroPrep Labs does not guarantee uninterrupted access, error-free performance, examination success, certification, employment outcomes, or regulatory compliance.
 
10. Limitation of Liability
 
To the fullest extent permitted by law, AeroPrep Labs, LLC shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
 
In no event shall total aggregate liability exceed the amount paid by you for the subscription giving rise to the claim.
 
11. Indemnification
 
You agree to indemnify, defend, and hold harmless AeroPrep Labs, LLC and its members, officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the service;

• Your violation of these Terms;

• Your misuse of the AI system;

• Your violation of applicable laws or regulations.
   

12. Arbitration Agreement and Class Action Waiver
 
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
 
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in the State of Wisconsin unless otherwise agreed.

You and AeroPrep Labs agree that:

• Arbitration shall be conducted on an individual basis only;

• Class actions, collective actions, and representative actions are waived;

• You waive any right to participate in a class or consolidated proceeding;

• You waive the right to a jury trial.
   

The arbitrator shall have exclusive authority to resolve disputes regarding the interpretation, applicability, or enforceability of this arbitration provision.

Notwithstanding the foregoing, AeroPrep Labs may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or enforce platform security protections.

13. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and AeroPrep Labs, LLC regarding use of the service and supersede any prior agreements or understandings.

16. Changes to These Terms

AeroPrep Labs may update these Terms at any time. Continued use after updates are posted constitutes acceptance of the revised Terms.
